What Cherry Hill Town Homes's governing documents say
Cherry Hill Town Homes is a townhome community in Phoenix, Arizona — a planned-unit-development where you own your individual townhome and lot while the association owns and maintains shared Common Areas, funded by per-lot assessments levied against all owners.
- What you own & maintain: You own your townhome unit and lot. You must maintain the building exterior, roof, doors, windows, sewer and drainage pipes, patios or balconies, parking, and storage areas in good condition. Water and sewer utilities are metered separately to your lot and are your sole responsibility.
- Assessments & annual increases: Monthly assessments fund association maintenance and operations. The Board may increase assessments annually by the greater of 5% or the Consumer Price Index without an owner vote. Increases beyond that require a 2/3 vote of owners from each voting class. Capital improvements require a separate 2/3 approval.
- Late payment consequences: Delinquent assessments (10+ days late) incur late charges and 12% annual interest after 30 days. The Association can file liens against your lot, foreclose to recover unpaid amounts, and suspend your voting rights and access to recreational facilities while delinquent.
- Architectural review & exterior changes: No building, fence, antenna, patio enclosure, or exterior alteration may be erected without written Board approval of plans, specifications, color, materials, and location for design harmony with the surrounding property.
- Residential use only: The community is restricted to residential dwelling use. No business, commercial, manufacturing, vending, or non-residential activity is permitted (other than the developer's sales and construction activities during the initial sales phase).
- Parking & vehicle rules: Vehicles must be parked in designated spaces. Temporary parking is allowed for guest vehicles, delivery trucks, and loading/unloading. Commercial trucks exceeding 3/4 ton and buses are prohibited without Board written approval.
- External fixtures & modifications: No antennas, clotheslines, AC equipment, water softeners, fences, or awnings may be installed without Board approval. Window coverings are limited to curtains, blinds, drapes, or shades; paint, foil, or sheets are prohibited. External clothes laundering and outdoor speakers are not permitted without approval. Vehicle repairs are prohibited except minor tuneups and oil/spark plug changes in your garage.
- What this doesn't cover: The sections governing pet policies (Section 8.13) and lease/rental rules (Section 8.14) are referenced in this document but the actual text is not included in this excerpt, so those restrictions cannot be summarized.
