This is an amendment to the governing documents for Cody-Nido Condominium, a condominium community in Phoenix, AZ. It adds rules about who pays the insurance deductible when damage occurs and who is responsible for mold remediation. This is not the full set of rules — it only supplements the existing Declaration.
- Insurance deductible responsibility: If damage occurs solely to your unit, you pay the full deductible (or full repair cost if less than deductible), unless another owner caused it. If damage is to multiple units, the deductible is prorated by damage percentage. If damage is solely to common elements, the association pays unless an owner's negligence caused it (then that owner pays the full deductible). If damage is between two units, those owners decide who pays (the association will not get involved). The board can split the deductible between owners at its discretion.
- Mold remediation: Mold is not covered by the association's insurance. You are responsible for all mold remediation inside your unit, including cleaning furniture and alternate lodging costs. If your act or neglect causes mold in common elements or another unit, you must remediate and provide certification of proper remediation. If you refuse, the association may access your unit to remediate and charge you, with that charge becoming a lien.
- What this document doesn't cover: This amendment does not cover typical condominium rules such as pet limits, leasing restrictions, age requirements, parking, or architectural controls. Those rules are in the main Declaration and other documents not included here.
