Montelucia Oasis Suites is a condominium community within an integrated resort in Phoenix, AZ. Unit owners own their individual suites, but the Declarant (Montelucia Hotel, LLC) retains extensive control over maintenance, services, and amenities, operating the property as a unified resort. This document applies to unit owners and outlines their rights and obligations within the resort framework.
- What you own & maintain: You own the interior of your suite. The Declarant maintains all exterior areas, common elements, doors, windows, and major systems, and may also offer interior maintenance services for a fee. Owners must keep interiors in first-class condition consistent with the 'Resort Standard'.
- Leasing & rentals: Leases must be in writing and subject to the declaration. Occupancy is limited to 2 persons per bedroom. Owners may participate in the hotel rental program; if they do, the unit cannot be rented for more than 30 consecutive days without check-out/check-in. Timeshare or fractional ownership is prohibited.
- Pets: No animals or birds are allowed in any unit unless expressly permitted in writing by the Declarant, in its sole discretion, and subject to any rules it imposes.
- Fees & assessments: Owners pay assessments for shared resort costs, exterior and insurance costs, HVAC, a daily Oasis Suite Fee, and a 1% transfer fee on sale. A budget is provided annually by December 1. The Declarant may also charge fees for optional services.
- Alterations & improvements: No exterior alterations or improvements are allowed without Declarant's prior written approval. Interior non-structural changes that don't affect exterior appearance or systems do not require approval.
- Amenities & services: Owners and guests have a license to use 'General Resort Amenities' (those available to hotel guests at no extra charge). Parking is provided (one space per unit, valet may incur extra fee). Declarant provides mail, TV/internet, HVAC, garbage, pest control, concierge, and optional maid service.
- Use restrictions: Units are for single-family residential use only. No business or trade is allowed except renting the unit. No signs, open houses, or lockboxes are permitted. Owners must comply with all applicable laws and town documents.
