What Tower Residences at Hotel Valley Ho, a Condominium's governing documents say
Tower Residences is a condominium community within the Hotel Valley Ho resort complex in Scottsdale, AZ. You own your unit and a share of common elements, but the entire project is governed by a Master Declaration that gives the hotel property owner significant control. The rules here apply to unit owners, with additional requirements from the master documents.
- Use & occupancy restrictions: Units are for single-family residential use only; no businesses, trades, or offensive activities. No animals unless permitted by the hotel property owner. No signs or window coverings visible from outside without approval. Nuisances and hazardous materials are prohibited.
- Leasing & rentals: Leasing is allowed, but units on the top (7th) floor cannot be leased for less than six consecutive calendar months. All other floors may have shorter leases; no minimum is specified for them.
- Alterations & improvements: Nonstructural interior changes do not need board approval, but structural alterations, changes to perimeter walls, or any change visible from the building exterior require prior written board approval. Board may also require a licensed architect/engineer certification.
- Maintenance responsibilities: The association maintains common elements (including structural parts of limited common elements). Unit owners maintain their units and certain limited common elements like balconies, doors, windows, and HVAC equipment. Owners must keep their unit and assigned limited common elements clean and tidy.
- Assessments: Common expense assessments are based on each unit's square footage. Special assessments may be levied. Delinquent assessments accrue 18% annual interest and late fees. Assessments are secured by a lien subordinate to first mortgages and the hotel property owner's master declaration lien.
- Insurance: The association must carry property insurance on units and common elements (100% replacement cost), liability insurance (minimum $2M per occurrence), workers' comp, and directors & officers coverage (minimum $2M per claim, adjusted for inflation). Policies must name unit owners as insureds and include no-subrogation clauses.
- Relationship to hotel property: The condominium is surrounded by the hotel and subject to a Master Declaration. Hotel property owner has rights to enforce standards, assess costs, and restrict uses (e.g., pets, signs). Master documents take precedence over this declaration in case of conflict.
