Copper Terrace is a homeowners' association for a commercial office complex (formerly residential patio homes) in Phoenix, AZ. This document is a 1982 amendment to the original CC&Rs that converted the property to commercial office use and updated rules. The amendment is not the full governing document—original CC&Rs still apply where not amended.
- Use & occupancy: Lots may only be used for commercial office (C-O) purposes as defined by Phoenix zoning, per the amendment. Any other use requires Board approval.
- Pets: No animals, rabbits, or livestock may be raised, bred, or kept in any lot or common area.
- Assessments: Annual assessments are based on each unit's floor space proportion. Monthly payments are 1/12 of the estimated budget. The Board may levy a further assessment if funds are inadequate, with 10 days' notice.
- Common area rights: Owners have easement rights to common areas, subject to reasonable fees, and can lose voting/use rights for unpaid assessments or rule infractions (up to 60 days). The association may dedicate common areas with a 2/3 vote.
- Insurance: The association may carry master policies for fire, extended coverage, liability, workers' comp, and other insurance as determined by the Board.
- Condemnation: If common area is taken by eminent domain, compensation is paid to the association and distributed per lot, with mortgagees paid first.
