What Caballo Ranchos's governing documents say
Caballo Ranchos is a single-family residential subdivision in Scottsdale, AZ, governed by restrictive covenants recorded in 1962 and binding on all lot owners. These covenants dictate minimum home size, setbacks, fence heights, animal keeping, and parcel splitting, and run with the land, automatically renewing every 10 years after 1992 unless changed by a majority vote of owners. There is no homeowners association; enforcement is by any lot owner through legal action.
- Building & lot use: Each lot is limited to one single-family dwelling, a private garage or carport for no more than two cars, and a one-story stable/tack room (if any). The stable must be on the rear one-third of the lot and be harmonious with the main residence. No building may be used for commercial purposes, and no garage or stable may be used as a residence.
- Minimum home size: Any dwelling house must have a ground floor area of at least 1,300 square feet, excluding open porches, pergolas, or attached garage.
- Setbacks & fences: Front walls must be at least 20 feet from the front property line (porch, garage, or carport may project up to 5 feet). Side walls must be at least 15 feet from each side property line. Front fences or walls over 3 feet high are prohibited closer than the front wall of the house (or 20 feet if no residence built). Side/rear fences or walls (other than the building itself) may not exceed 6 feet. Hedges over 3 feet are not allowed within 20 feet of the front property line.
- Animals & livestock: No poultry or livestock allowed except horses—up to four per lot, for the sole use of the owners and their invited guests. Horses and facilities must be kept clean and not become a nuisance. Commercial animal husbandry is prohibited.
- Subdivision & parcel splits: Lots cannot be subdivided into smaller parcels except that specific portions of Lots 1-2 and Lots 3-4 may create additional lots of minimum dimensions (170 ft x 115 ft for most, with Lot 4 minimum 170 ft x 100 ft). The remaining original lots must also meet those minimum dimensions.
- Easements & utilities: Easements for utilities and drainage as shown on the recorded plat are reserved. No structures, plantings, or materials may interfere with installation or maintenance within those easements.
- Nuisance & nonconforming use: No noxious or offensive activity may be carried on, nor anything that may become an annoyance or nuisance to the neighborhood.
- Duration & amendment: The covenants run with the land and are binding until November 1, 1992, after which they automatically renew for successive 10-year periods. They may be changed in whole or in part by a majority vote of the then-owners of the lots.
