Sands East Townhouses is a townhome community in Scottsdale, AZ—each owner owns a lot and attached townhouse, with party walls between units. The association owns and maintains common elements such as streets and recreational facilities. Owners are responsible for exterior maintenance of their own unit, subject to strict architectural controls. The rules bind owners, tenants, and guests.
- Party walls: Party walls (walls on lot lines including patio walls) are shared: each adjoining owner must share repair costs if damage is from common causes; if caused by one owner, that owner pays all costs. Access for repairs must be allowed, but the accessing owner pays for any damage. Disputes go to arbitration.
- Architectural review: All exterior changes (buildings, fences, walls, color changes) must be approved in writing by the Board. The basic exterior color must be Navajo White (Dunn-Edwards specification); carport beams must be Weathered Brown or same Navajo White. Door colors may be selected from an approved palette. Garage doors are allowed only if painted Navajo White with long horizontal panels and no windows (or one row of windows). If no Board action within 60 days, approval is deemed given.
- Use restrictions: Each lot is limited to single-family occupancy—either related persons or a group of no more than three unrelated persons. No commercial activity is allowed unless it is not detectable from outside and complies with zoning. Pets are limited to two four-legged domestic pets; dogs must be leashed off-property. Parking is limited to passenger automobiles; trucks, boats, and RVs may park only 48 hours per month. Only one small temporary sign for sale/rent (max 5 sq ft) allowed. No exterior antennas except those governed by FCC rules.
- Assessments & fees: Annual assessments are levied uniformly per unit (1/55 of total). The Board may increase assessments annually by the CPI change without a vote; larger increases require 2/3 member approval. Special assessments up to 10% of the annual assessment may be levied by the Board; anything above requires 2/3 vote. Late payments bear interest and create a lien on the property, enforceable by foreclosure. Fines for violations range from $10 to $500 per occurrence, plus daily penalties for continuing violations.
- Insurance: The Association must obtain property insurance on all townhouses and common elements (fire and other hazards), and liability insurance for common areas. Owners must provide proof of their own insurance coverage within 30 days or face a penalty. If the Association pays for an owner’s insurance due to non-provision, the cost becomes a lien. Owners may also purchase additional coverage at their own expense.
- Leasing & rentals: No lease or sub-lease may exceed one year in term. Renters must sign a consent to be bound by the CC&Rs before occupancy. Single-family occupancy rules apply to renters. Owners who rent their unit lose voting rights and the right to use recreational facilities during the rental period.
- Voting rights: Only the record owner who resides in the unit at least four months per year and does not rent it out may vote. Owners who are in arrears or in violation of the rules lose voting rights and the right to use recreational facilities until cured.
