Scottsdale Abrivado Condominiums is a 48-unit condominium community in Scottsdale, AZ. You own your individual unit (defined as the air space within specific boundaries) plus an equal 1/48 share of all common elements maintained by the association. The association, governed by a 3–7-member board, assesses all unit owners equally to cover insurance, maintenance, utilities, and reserves.
- What you own & maintain: You own the interior space of your unit as defined in the building plat, including finished surfaces and all fixtures within those boundaries. You're responsible for all maintenance inside your unit—plumbing/utility lines serving only your unit, windows/doors/screens, balconies/patios, and any garage attached to your unit. The association owns and maintains the building structure, exterior, and all shared systems.
- Monthly and annual assessments: The initial monthly assessment is $120/month ($1,440/year), charged equally to all units. Beginning the year after the first unit sale, the maximum annual assessment increases annually by the greater of 5% or the Consumer Price Index percentage, without a member vote. Any increase beyond that formula requires a 2/3 vote of each ownership class.
- Special assessments for capital improvements: The association may levy special assessments for major repairs or replacements to common elements, but only with approval of two-thirds of voting members (in person or by proxy) at a properly noticed meeting.
- Voting & developer control: Each unit owner gets one vote per unit owned. The Declarant (developer) initially holds three votes per unit owned but converts to Class A membership (one vote per unit) when Class A votes equal or exceed Declarant votes, or on the fourth anniversary after the Declarant stops offering units for sale—whichever is first.
- Late payments & enforcement: If an assessment is not paid within 15 days, you owe a late charge (amount in bylaws). If not paid within 30 days, interest accrues at 18% per annum. The association can suspend your voting rights and recreational-facility access for the entire period a payment is delinquent, and may foreclose on the assessment lien after 30 days' written notice. All collection costs—including attorneys' fees—are added to the delinquency.
- Association entry rights: The association may enter your unit with reasonable advance notice to correct violations of the declaration or rules, or without notice in emergencies. All costs of correcting violations are assessed against the unit owner.
- Insurance: The association obtains and pays for multi-peril coverage (100% replacement cost), $1 million public liability, fidelity bonds for financial handlers, and other required insurance as part of common expenses. You are responsible for verifying coverage and purchasing any additional personal liability, theft, or other insurance you want.
- Utilities: Water service is metered collectively and paid by the association as a common expense. All other utilities (electric, gas, etc.) are separately metered to each unit, and owners pay their own utility bills directly.
