What Heatherbrae House's governing documents say
Heatherbrae House is a 25-unit condominium community in Phoenix, AZ. You own your individual unit and an undivided 1/25th interest in the common elements, which the association maintains. The amended declaration sets rules for occupancy, pets, leasing, and assessments.
- Occupancy & use: Units are for residential use only, limited to single-family occupancy defined as no more than two unrelated individuals living together.
- Pets: Maximum two domestic pets per unit (dogs and/or cats), each under 50 pounds at maturity. Small birds also allowed, but no commercial breeding. Pets exceeding these limits at the time this amendment was recorded are grandfathered until they die.
- Leasing & rentals: Before leasing, owners must submit a landlord registration form to the association and provide the names (and ages) of all occupants. No minimum lease term is stated in this document.
- Assessments & fees: Each unit pays 1/25th of the association's annual budget, divided into 12 monthly installments. Late payments incur a fee of $15 or 10% of the assessment (whichever is greater). The association may place a lien on the unit if assessments are 60 days or more past due.
- What you own & maintain: You own and maintain the interior of your unit (including plumbing, electrical, and other utilities within the walls). The association maintains the common elements, exteriors, roofs, and common areas. Owners are responsible for trees, bushes, and plants in their individual patio areas, but those trees cannot exceed the roof line.
- Architectural review: No exterior additions, alterations, or changes to fences, hedges, or walls may be made without prior written approval from the association's board of directors, who review plans for conformity and harmony.
- Signs & antennas: No advertising signs except one 'For Rent' or 'For Sale' sign (max 5 sq ft) or one 2'x2' window sign. No exterior television or radio antennas or satellite dishes without board approval.
- Party walls: Party walls are shared walls between units. If damaged by an owner's act, that owner pays for repairs. If damaged by other causes, the adjoining owners share the cost equally. All repairs require board approval.
