What Vista Larga Condominiums's governing documents say
Vista Larga Condominiums is a condominium community in Scottsdale, AZ — you own your unit and an undivided interest in common elements; the association maintains common areas and carries insurance, funded by assessed common expenses.
- What you own & maintain: You own the interior space within your unit's walls, floors, and ceiling, plus any exclusive-use patio, balcony, or storage area. Structural components and utility lines serving more than one unit are common elements maintained by the association.
- Parking & vehicles: Each unit has an exclusive-use carport (e.g., Unit 1 gets carport C-1). The board may assign additional unassigned parking spaces. Use is subject to board rules.
- Assessments & fees: Owners pay monthly assessments for common expenses (insurance, maintenance, reserves) proportional to their percentage interest in common elements. Delinquent payments accrue interest at the greater of 18% per year or prime + 4%, plus late fees and attorneys' costs, and become a lien on the unit subordinate only to first mortgages.
- Insurance: The association provides property, liability, flood (if applicable), and fidelity insurance. Owners must insure their own contents and personal liability. First mortgagees receive notice of cancellations and claims.
- Damage & reconstruction: The document defines partial, substantial, and total destruction based on the percentage of units damaged. The Board oversees restoration using insurance proceeds; reconstruction must substantially match original plans unless impracticable, and then requires approval of a majority of first mortgagees.
- Voting & association control: The association has two membership classes: Class A (all owners except declarant) with one vote per unit weighted by common-element percentage, and Class B (declarant) with three votes per unit. Declarant controls the board until 120 days after Class A votes equal or exceed Class B, or three years after the first unit sale, whichever comes first.
