Scottsdale Shadows I is a condominium (horizontal property regime) in Scottsdale, AZ — you own an apartment unit and may also own a separate numbered parking stall, plus a share of the common elements. The association (Council of Co-Owners) manages the property, maintains common areas, and carries master insurance. This is a full set of covenants and restrictions, not an ancillary document.
- Age restriction: At least one occupant per unit must be 39 years of age or older, and no person under 16 may reside in any unit.
- What you own & maintain: You own your apartment unit (including any attached patio/balcony) and may separately own one or more numbered parking stalls. Unit boundaries are the interior surfaces of unfinished walls and the space between floor and ceiling. You are responsible for maintaining your unit, including installing and maintaining carpeting on all floors except kitchen and bath.
- Leasing & rentals: Units may be leased to a single family for residential purposes, but any lease must comply with the age restriction. No minimum lease term is specified in this document.
- Right of first refusal on resale: Before selling your unit, you must first offer it to the Council of Co-Owners. The Council has 10 days to either consent to the sale or designate another buyer on the same terms. Failure to act within 10 days is deemed consent. No unsightly objects on patios or balconies (as determined by the Board). Painting or decorating patio/balcony walls and ceilings requires prior approval. Carpeting is required on all floors except kitchen and bath.
- Insurance & damage: The Council maintains master property insurance covering replacement cost of buildings and improvements. If damage exceeds 50% of replacement value, owners may vote (75% of votes) not to rebuild, triggering a sale and distribution of proceeds. If insurance is insufficient, the Council can levy a special assessment to cover the deficiency.
