The Articles establish the HOA's legal structure, membership, voting, and general powers. The application outlines the process for homeowners to get approval for exterior changes. This document does not contain detailed community rules like pet limits, leasing restrictions, or age requirements.
- Association membership & voting: Membership is limited to lot owners. Two classes: Class A (all owners except Declarant) get one vote per lot; Class B (Declarant) gets three votes per Class A vote until certain events. Joint owners must vote as a unit; voting rights can be suspended if assessments are overdue for 15 days or for rule infractions (up to 60 days).
- Powers of the Association: The Association can maintain common areas, levy assessments, enforce architectural control, borrow money, and manage common property. Its purposes include orderly development, maintenance, and promoting health, safety, and welfare of residents.
- Architectural design review: Any exterior change (painting, landscaping, additions, pool/spa, etc.) requires prior written approval from the Architectural Design Review Committee or Board. Homeowners must submit an application with plans, colors, materials, contractor info, and expected completion date. The Association may approve, approve with conditions, or disapprove within 30 days.
