Crystal Point Avondale is a single-family residential subdivision in Phoenix with mandatory homeowner association membership. You own your lot and residence but are subject to covenants, assessments, architectural review, and use restrictions enforced by the HOA.
- What you own & maintain: You own your lot with a single-family residence and garage; the association owns and maintains common areas (Tracts A–G).
- Annual assessments: Initial cap is $192 per lot per year. The board can increase assessments by up to 10% yearly without a member vote; increases beyond that require two-thirds member approval. Assessments are property liens with priority over most mortgages.
- Assessment payment & delinquency: Assessments are due quarterly (or on a schedule the board sets) and become delinquent five days after the due date. Delinquent amounts accrue interest at a board-set rate, plus collection costs and attorney fees, and are enforceable through property lien foreclosure.
- Fees & capital contributions: First-time lot buyers must contribute two months of common expenses as working capital to the association. Transfer fees apply when lots are sold (amount set by the board).
- Architectural approval required: Any construction, alteration, or improvement requires written approval from the Architectural Committee before work begins; reasonable review fees may apply.
- Common area access & rules: You have shared easement rights to common areas; the association can adopt rules limiting access and charge special-use fees for facility use. You can delegate your rights to family members, tenants, guests, or invitees.
- Developer voting control: Elliott Homes (the developer) initially holds Class B membership with 3 votes per lot and pays only 25% of assessments on its own lots. This control ends January 1, 2006, or when other members' votes equal the developer's votes plus 90 days, whichever comes first.
