Desert Willow Estates At Tatum Ranch is a single-family residential subdivision within the larger Tatum Ranch master-planned community in Phoenix, AZ. This Tract Declaration adds extra covenants to the master Declaration, but they mostly apply during original construction and are aimed at builders, not current homeowners. - Land use & density: All lots are classified as Single Family Residential. No more than one dwelling unit may be built per lot.
- Builder obligations (construction phase): Builders must integrate all new improvements with existing ones, build perimeter walls per Design Guidelines (stucco and paint), cover party walls abutting public areas or common areas with stucco and paint, and fully landscape front and side yards before occupancy (or within 90 days after C.O. for spec homes). All landscape plans need advance Architectural Committee approval.
- Homeowner disclosure at sale: When a builder sells a lot to a new owner, the builder must give the buyer materials about the master development plans, the Declaration, Association assessments, Design Guidelines, and any water conservation info. The buyer must sign a form acknowledging receipt.
- Amendment & interpretation: This Tract Declaration is part of the master Declaration and can only be amended as the master Declaration allows. Any amendment must be recorded and follow zoning restrictions.
