Elevate on the Preserve is a planned community of townhomes in Phoenix, AZ — you own your lot and attached home, sharing party walls with neighbors. The homeowners association maintains common areas and enforces the rules in this Declaration of Covenants, Conditions and Restrictions (CC&Rs), which applies to all owners, residents, and guests.
- Residential use & home businesses: All lots and homes must be used exclusively for residential purposes. Limited home businesses are allowed only if entirely conducted indoors, not detectable from outside, and no customer visits or employees who are not residents.
- Leasing & rentals: Owners may lease only the entire lot and townhome, for an initial term of at least one month. No subleasing or assignments. Owners must provide tenant info to the association at least 10 days before the lease starts and provide copies of rules to tenants.
- Pets: Reasonable numbers of dogs, cats, and household birds are allowed as pets; the board decides what number is reasonable. Dogs must be on a leash (max 6 ft) off the owner's lot, and feces must be removed. Structures for pets may not be visible from neighboring property.
- Parking & vehicles: Residents must park in their garage; if space is insufficient, parking is allowed on the driveway only. No street parking for residents' vehicles. Overnight guest parking on streets is prohibited. No commercial vehicles, inoperable vehicles, or storage of vehicles visible from neighboring property.
- Architectural review: All exterior construction or modifications (including fences, landscaping, paint) require prior written approval from the Design Review Committee. Interior work that doesn't affect exterior appearance does not need approval. The committee may deny even code-compliant projects for aesthetic reasons.
- Signs & flags: No signs visible from neighboring property without approval, except certain flags protected by state law. The board may regulate flag size, location, and number (max two flags; flagpole height limited to rooftop height).
- Garage requirements: Garages must remain functional for parking at least two cars. They cannot be converted to living space or used for storage that prevents parking. Garage doors must be kept closed except when entering or exiting.
