What Summit at South Mountain's governing documents say
Summit at South Mountain is a standard single-family homeowner association (HOA) in Phoenix, AZ — you own your lot and home, and the association maintains common areas. This Declaration binds all homeowners, occupants, and tenants. It covers design controls, permitted uses, leasing, parking, maintenance, and assessments.
- Residential use & home businesses: Lots are for residential use only. Limited home businesses are allowed if not detectable from outside (no signs, traffic, or noise), and must comply with zoning.
- Pets: Only a reasonable number of recognized house pets (as determined by the board) are allowed, kept as domestic pets only. No livestock, poultry, or commercial breeding.
- Leasing & rentals: Leases must be for the entire lot for a minimum of 30 days. Owners are responsible for tenant compliance with all HOA rules.

- Parking & vehicles: Only private passenger vehicles or pickup trucks under 1 ton, 84 in height/width, and 228 in length may be parked in driveways. No commercial vehicles, RVs, boats, or trailers except in garages or designated areas.
- Party walls & shared fences: Owners sharing a wall or fence must equally share repair costs if damage is from ordinary wear; if caused by one owner, that owner bears the cost. Disputes go to the committee then board.
- Assessments & fees: Annual assessments are levied equally per lot, initially capped at $40/month (2002), with annual increases tied to CPI or 20%, whichever greater. Special assessments require a 2/3 vote of members. A working capital fee (1/6 of annual assessment) is due upon purchase, plus a transfer fee set by the board. Late payments incur interest, fees, and potential lien/foreclosure.
