Encanto Garden Townhouses is a condominium community in Phoenix, AZ — you own your individual townhouse unit and an undivided 1/128th interest in the shared common areas. The association maintains exteriors, roofs, parking, landscaping, and common elements, while you maintain the interior, evaporative cooler, and ductwork. This declaration is the full rulebook for the community.
- What you own & maintain: You own the interior of your unit (bounded by perimeter walls, floors, ceilings) and the evaporative cooler and ductwork serving it. The association maintains the building exteriors, roofs, common areas, parking lots, landscaping, and recreational facilities. Party walls between units are shared and governed by specific repair rules.
- Assessments & fees: Annual assessments are set by the board; initially capped at $300 per unit, with annual increases of up to 5% by board vote. Larger increases require two-thirds membership vote. Special assessments for capital improvements require three-fourths board vote and two-thirds member approval. Assessments are uniform except units with covered parking pay $12 less per year.
- Leasing & rentals: Leases for less than 30 days or that include hotel-like services (maid service, etc.) are prohibited. Otherwise, you may lease your unit, subject to the declaration, bylaws, and HUD Regulatory Agreement.
- Pets: Only commonly accepted household pets are allowed, and they may not be kept for commercial purposes. No animals, fish, or birds may be raised or bred.
- Architectural review: Any exterior improvements (buildings, fences, walls, repainting) require prior written approval from the association. Plans must be submitted; if no response within 30 days, approval is deemed granted. No changes may exceed the original square footage of the unit.
- Use restrictions: Units are for single-family residential use only. No business, commercial, religious, or institutional activities. No temporary structures, trailers, or tents. Only one sign (max 16x24 inches) for sale or rent, displayed from inside a window.
- Parking & vehicles: Parking spaces are designated as restricted common areas. Covered and uncovered spaces are allocated by the board. Units assigned a covered parking space receive a $12 annual assessment reduction.
