What Estate Questa Verde Improvement Association's governing documents say
This is an amendment to the Declaration of Restrictions for estate Questa verde, a planned area development (HOA) in Phoenix, AZ. It modifies the original rules but does not contain the full governing documents. Residents and owners should also refer to the original Declaration.
- Name change: The development's name was changed from 'Stoneridge' to 'estate Questa verde' throughout the original declaration and related documents.
- Builder's rights: During construction and sale, the builder may maintain facilities like offices, storage, signs, and model units on any portion of the premises as reasonably needed, without further approval.
- Parcel subdivision & ownership: Original parcels cannot be subdivided smaller than shown on the plat, but parcels can be combined. Conveyance of smaller units is allowed only if the new parcel is no smaller or larger than an original parcel, and then it is treated as one parcel with one vote.
- Assessment shares: Each developed parcel pays one full share of assessments. Vacant parcels (no dwelling) pay only one-fourth of a share after at least 10 dwellings have been built in the development.
- Lien for unpaid assessments: If an assessment invoice is unpaid within 30 days of mailing, it becomes a lien on the parcel. The association may record a lien and foreclose in the manner provided for materialmen's liens.
- Transfer & approval rights: Any sale, lease, or transfer requires written notice to the Board of Directors. The Board has 15 days to approve or disapprove and also has an option to purchase the parcel on the same terms. If the Board does not act, the transfer is deemed approved; if disapproved, the owner can get approval from owners of at least 10 other parcels.
- What this document doesn't cover: This is only an amendment to the original Declaration of Restrictions. It does not include the full rules on maintenance responsibilities, architectural controls, use restrictions, pet policies, or other typical HOA regulations. Those are found in the original declaration and other governing documents.
