Palacio Del Sol is a 48-lot single-family residential planned area development in Phoenix, AZ. You own your lot and house; the Palacio Del Sol Improvement Association maintains common areas and can manage exterior maintenance. This document is the full rulebook for owners.
- What you own & maintain: You own your lot and house interior and exterior; the association maintains common areas, but may optionally take over exterior landscaping and painting. You are responsible for termite control and all interior upkeep.
- Construction & size rules: Only new single-family homes with at least 1,100 square feet of ground floor area (excluding garage, carport, and open roofed areas) are allowed. All construction needs association architectural approval.
- Architectural review: Plans for any new building, fence, wall, antenna, or exterior change must be submitted to the board, which has 30 days to approve or reject. The board can deny based on aesthetic or other reasons.
- Leasing & rentals: Only an entire lot with its house may be rented, and only to a single family. Leasing a portion is prohibited. The association also has a right of first refusal on any sale or lease.
- Use restrictions: Lots are for single-family residential use only. No business, professional, commercial, religious, or institutional uses. No noxious or offensive activities. No temporary structures (except construction sheds).
- Animals & vehicles: Up to two common household pets allowed, not for commercial breeding. Trucks, boats, trailers, campers, and similar vehicles must be parked in setbacks, alleys, or carports (not front yards or streets) unless board approves. All vehicles must be operated by licensed drivers.
- Assessments & liens: Each lot pays a uniform annual assessment and may be subject to special assessments (requiring 66⅔% member vote). Delinquent assessments accrue 8% interest and become a lien enforceable by foreclosure. The assessment lien is subordinate to first mortgages.
- Party walls & easements: Walls built on dividing lines between units are party walls; adjoining owners share repair costs (unless damage is caused by one owner, who bears full cost). Utility and encroachment easements exist across the property.
