What 12th Street Registry's governing documents say
12th Street Registry is a single-family home HOA in Phoenix, AZ. This document is an amendment to the original CC&Rs that adds specific restrictions on renting out your home. It applies only to property owners (you must own a lot) and is especially important for anyone who plans to lease their home.
- Leasing & rentals: Owners must have lived in their home for at least two years before they can rent it out. This rule does not apply to owners who already owned their lot when the amendment was recorded (grandfathered), but if they sell, the new owner is subject to the two-year requirement. Timeshare or straw transactions that circumvent the rule are prohibited.
- Rental registration & fees: The board may require each rental to be registered and can charge a registration fee up to 2% of the annualized rent. Owners must include in the lease a clause where the tenant agrees to follow community rules and authorizes the association to evict the tenant for violations.
- Disclosure requirement: Owners must disclose this rental restriction to anyone purchasing their home. The amendment also applies to any purchaser who signs a contract after the amendment was recorded (June 7, 2006).
- What this document doesn't cover: This is only one amendment to the HOA's full rulebook (the Declaration of Covenants, Conditions, and Restrictions). It does not cover pet policies, parking, maintenance obligations, assessments, or other typical HOA rules. Those are found in the original Declaration and other governing documents.
