Eleven Hundred Bethany East is a small townhome community in Phoenix, AZ, with 18 single-family attached residences (lots) and common areas. The HOA manages and maintains the common elements, and all lot owners are members of the association. This document is the full set of covenants, conditions, and restrictions that bind all owners, residents, and guests.
- Residential use & restrictions: Each lot is limited to one single-family residence plus incidental garages and outbuildings. No business use is allowed except for home-based work that doesn't increase traffic, parking, or deliveries. No temporary structures (trailers, mobile homes, etc.) may be used as residences.
- Pets: Only generally recognized house and yard pets are allowed, kept as domestic pets and not for commercial purposes. Pets must be confined to the owner's lot; dogs must be leashed when off the lot. Owners must clean up pet feces immediately. The board can decide if a pet is a nuisance or if the number is reasonable.
- Parking & vehicles: Only automobiles, pickup trucks, and vans of private passenger class may be parked regularly on driveways. No abandoned, inoperable, or unlicensed vehicles may be stored in view. RVs, boats, campers, etc., owned by the lot owner may be kept if attractively screened and concealed, except for 72-hour loading/unloading periods. No vehicle repairs (except emergency) are allowed in view.
- Leasing & rentals: Owners may lease their units, but only as individual units and with a written lease. A copy of the lease must be delivered to the association secretary. The owner is jointly and severally responsible for any lease violations. The lease must state that it is subject to the declaration.
- Assessments & fees: Regular assessments are levied equally on all lots to cover common expenses. The board sets the amount and payment schedule (monthly, quarterly, or annually). Special assessments for capital improvements require approval by two-thirds of members voting at a meeting. A transfer fee is due from the seller upon close of escrow, as set by the board.
- Maintenance responsibilities: The association maintains all common areas, including the street. Each owner maintains their lot, residence, and landscaping. For shared boundary walls, adjacent owners split maintenance costs equally, unless damage is caused by one owner's negligence. Repairs to a boundary wall require written consent from the adjoining owner.
- Antennas & window coverings: Antennas that cannot be shielded from view require board approval. Windows visible from neighboring lots or the street may not be covered with aluminum foil, reflective material, bed sheets, newspaper, or similar materials.
- Amendment & enforcement: The declaration runs until December 31, 2033, and automatically renews for 10-year periods. Amendments require an instrument signed by owners of at least two-thirds of the lots, recorded in Maricopa County. The board has the right to enforce all provisions, and its interpretation of the declaration is final unless a court rules otherwise.
