Villa Chapala is a single-family home subdivision in Phoenix, AZ, governed by a homeowners association (HOA). You own your lot and house, and the association owns and maintains the common areas (Tracts A, B, C) — including landscaping, spa, pool, and utilities — funded by monthly assessments. The rules apply to all owners, residents, tenants, and guests.
- Assessments & fees: Monthly assessments are set by the board, initially capped at $75 per lot until the first lot is sold, then can increase up to 10% per year without member vote. Special assessments for capital improvements require majority approval. Assessments are a lien on the property and personal obligation; unpaid assessments accrue 10% interest and late fees.
- Leasing & rentals: Leases must be in writing for a term of at least six months. Tenants must agree in writing to comply with all governing documents, and the owner must provide a copy to the association before the tenant takes possession.
- Pets: Dogs, cats, and other household pets are allowed, but no commercial breeding or raising of animals, livestock, or poultry is permitted.
- Architectural review & exterior changes: No exterior alterations, additions, or improvements (including fences, walls, antennas, awnings, landscaping changes) may be made without prior written approval from the Board of Directors. Non-structural interior changes do not require approval, but the owner is liable for any damage caused.
- Parking & vehicles: No vehicles, boats, campers, or wheeled toys may be parked or left unattended on common areas. Abandoned or inoperable vehicles may not be stored on any lot where visible from other lots or streets. The board may restrict parking on common area and tow violators at owner expense.
- Prohibited uses & nuisances: Residential use only; no business activities. No obnoxious or offensive activity, no structures of temporary character (trailers, tents, etc.). Garbage must be screened and regularly removed. No window air conditioners, reflective materials on windows, or items that interfere with others' quiet enjoyment.
- Common area use & enforcement: All owners have an easement to use common areas, subject to reasonable fees, fines, and suspension of privileges for nonpayment or rule violations. The board can adopt uniform rules and limit guests. Owners may delegate use to family, tenants, or contract purchasers. The association can enforce rules via fines, suspension of voting rights, and legal action.
- Membership & voting: Each lot owner automatically becomes a member with one vote per lot (Class A). The developer (Declarant) has Class B membership with 18 votes per lot until all lots are sold or 5 years from recordation, whichever is earlier. Voting rights can be suspended for nonpayment or default.
