Riviera Gardens is a townhome community in Phoenix, Arizona—you own your individual attached unit (townehouse) and share common grounds with other owners through the Riviera Gardens Association, which maintains landscaping, parking, streets, and recreational facilities via per-unit assessments. You're responsible for your unit's exterior, carport, and interior, and all owners must comply with design restrictions that bind current and future owners.
- What you own & maintain: You own your individual lot and townehouse as a freehold estate. The Association maintains common elements (landscaping, parking, streets, recreational facilities) and specified exterior walls. You are responsible for your townehouse exterior, carport, storage area, and all interior fixtures from the utility entry point inward.
- Monthly assessments & fees: Each owner pays a pro-rata share (1/16 of total) covering taxes, repairs, maintenance of common elements, landscaping, recreational facilities, and liability insurance (minimum $500,000). During builder control, the maximum monthly assessment is $15. Payments are collected monthly in advance; if unpaid within 20 days of month start, the amount becomes a lien on your property.
- Pets: Dogs, cats, and other household pets are allowed, provided they are not kept or bred for commercial purposes. Livestock and poultry are not permitted.
- Fences, antennas, boats & yard rules: Fences require Association approval and are limited to 5 feet in front yards and 6 feet in rear yards. Antennas must not exceed 5 feet, be roof-mounted, and require written permission. Boats and campers are not permitted on the property. Garbage and trash must use designated receptacles; excess trash cannot be kept in front yards or common areas.
- Shared party walls: Townhouses share party walls with adjacent units, with both owners having equal rights. If you or your guests damage a party wall, you must repair it within 30 days or the adjacent owner or Association may repair it and bill you. You cannot attach recreational items to the party wall, make noise through it, or penetrate it more than 1 inch from the exterior.
- Exterior changes & approvals: Any change to your townehouse's exterior color or style requires written Board approval. Major exterior additions, alterations, fences, hedges, walls, and antennas must be submitted with plans and specifications to an architectural committee for approval based on conformity with existing structures.
- Maintenance, repair & damage: You are responsible for maintaining your townehouse's exterior. If damaged, you must repair and rebuild within 30 days in a workmanlike manner matching original specifications. If you fail to repair, the Association may repair it and bill you, with the cost becoming a lien on your property.
- Insurance & loss recovery: The Association maintains liability insurance covering all buildings (minimum $500,000). You must prove adequate property insurance to the Board or allow the Association to obtain it at your expense. Insurance proceeds are used for repairs; if insufficient, the Association may assess owners for the shortfall.
