Fairway Court East is a condominium community in Phoenix, Arizona (Sun City Unit III), where you own your individual unit and share ownership of the building's common elements, maintained by the association. This is a strictly owner-occupied community with extensive Board approval requirements for most changes and alterations.
- What you own & maintain: You own your unit's interior space and exclusive appliances (HVAC, range, dishwasher, water heater, garbage disposal). The association owns and maintains all common elements, bearing walls, roofs, foundations, exterior utility lines, and exterior glass. Owners must maintain their units at their own expense, subject to Board approval.
- Rentals prohibited: No owner may rent or lease their unit under any circumstances. This is an owner-occupancy-only community.
- Pets & animals: No animals of any kind are permitted except service or support animals required by fair housing law. Service animals must be confined to the owner's dwelling or kept on a leash and under the owner's control; they are not allowed to run free.
- Parking & vehicles: Each unit is assigned one parking space. Vehicles must be currently licensed and registered. Inoperable vehicles (flat tires for 5+ days, up on blocks, unlicensed, or unregistered) are prohibited if visible from common areas. Motorhomes, boats, trailers, and campers are not allowed on common elements except for temporary loading/unloading (max 48 hours). Violators may be towed at the owner's expense.
- Exterior changes & Board approval: Nearly all exterior modifications require prior written Board approval, including antennas, satellite dishes, painting, landscaping, window treatments, awnings, screen doors, replacement windows/doors, and any interior changes visible from outside. Owners may not alter Association-planted shrubs, trees, or grass. Electrical work in units must be performed by a licensed, bonded, and insured contractor.
- Signs & displays: Prohibited signs visible from common areas or streets include commercial and political signs. Allowed: one residential ID sign (max 72 square inches), 'For Sale' or 'For Rent' signs (max 18" × 24" with 6" × 24" riders on the owner's unit), and Board-approved signs.
- Assessments & late fees: One-bedroom units pay $6 less annually than two-bedroom units; rates are uniform within each category. Delinquent assessments (unpaid after 30 days) bear 10% annual interest plus a $15 late fee per installment. Assessments create a lien on the unit. Special assessments for capital improvements require a majority vote of owners. One-bedroom units pay 75% of the two-bedroom rate for special assessments on building work. No exemptions or offsets are allowed.
- Board authority & voting: The Board has broad authority to approve/deny modifications, set rules, levy penalties, and enforce restrictions. Every unit owner is an automatic member and votes one vote per unit; Board elections occur annually.
