What Fiesta at Desert Ridge's governing documents say
Fiesta At Desert Ridge is a master-planned community of approximately 149 single-family lots in Phoenix, Arizona — you own your lot individually and the association maintains and insures the common elements (driveways, front yards, amenities), funded through regular and special assessments levied against owners.
- What you own & maintain: You own your lot as a freehold estate; the association maintains common elements (driveways, front yards, amenities, landscaping, and infrastructure). You have exclusive easement rights to your own driveway and front yard area.
- Assessments & fees: You pay regular annual assessments per lot for common expenses (maintenance, management, insurance, utilities, reserves). The association may also levy special assessments for capital improvements, compliance assessments to cure violations, and special benefit assessments for specific areas. Unpaid assessments become liens on your property.
- Architectural review & approval: Any exterior modifications—including painting, roofing, pools, fences, landscaping over 20 feet tall, patios, and decks—require written approval from the Architectural Control Committee before construction begins.
- Leasing & rentals: If you rent out your lot, your tenant automatically gains the right to use common amenities during the lease term. During that time, you forfeit your own right to use those amenities (except to access your lot for landlord duties).
- Parking & vehicles: You have an exclusive easement on your lot's driveway for vehicle access. Guest or temporary resident vehicles parked on public streets within the project are limited to 20 consecutive hours.
- Utilities & shared systems: You maintain your own water, sewer, gas, electric, and cable connections serving your lot. The association maintains the main trunk lines serving multiple lots. Neighbors and utility companies have easement rights to cross your property if needed to access or repair shared systems.
- Voting & membership: Regular owners (Class A members) have one vote per lot. The developer/Project Owner (Class B) initially has three votes per lot, which converts to one vote per lot when Class A votes equal Class B votes or by December 31, 2005, whichever comes first.
- Enforcement & rule violations: Violating the declaration or rules can result in compliance assessments (charges to your account), suspension of common-area use rights (up to 30 days for violations; indefinite for unpaid assessments), or liens against your property. These restrictions run with the land and bind all current and future owners.
