Gardener's Enclave is a planned residential community in Phoenix, Arizona, where you own your individual lot and home. The Homeowners Association maintains common areas and enforces architectural and use restrictions through a Design Review Committee, with assessments levied per lot to cover ongoing costs.
- What you own & maintain: You own your individual lot and residence; the association maintains designated common areas, plus certain landscaping and improvements within six feet of street curbs on individual lots (specified in supplemental declarations). Owners are responsible for interior remodeling, repainting, and everyday maintenance of their homes.
- Architectural review & approval: All exterior modifications — including building size/height, color, materials, landscaping, and fencing — require written Design Review Committee approval before work begins. Approval decisions can be purely aesthetic; the Committee has 45 days to respond or the application is deemed disapproved. A review fee may be charged.
- Restrictions on use: All properties are restricted to residential use only. Timesharing, cooperatives, and periodic-occupancy arrangements are prohibited. Lot subdivision, replating, and transfer of less than an entire lot require Design Review Committee and association approval.
- Assessments: The association levies regular assessments, special assessments (for unexpected costs), and enforcement assessments to cover maintenance, repairs, reserves, and administration. Assessments are charged per lot; specific dollar amounts are established separately by the Board and not included in this document.
- Developer control & expansion: During the Declarant Control Period (while the developer owns lots or holds purchase options), the developer can annex additional adjacent property, modify the development plan, appoint/remove Design Review Committee members, and approve certain lot changes without owner consent. This control ends once the developer exits the project.
- Dispute resolution: Disputes between owners and the association are addressed through mandatory mediation, with binding arbitration available if mediation fails. This applies to claims arising from construction defects, development, or association management.
