Copper Creek is a single-family home HOA located in Olathe, KS. This governing document, a Declaration of Restrictions, applies to all homeowners in the subdivision, setting rules for land use, construction, and property maintenance.
- Use & occupancy: Lots may only be used for single-family private residential purposes; no duplexes, apartments, or earth homes. Temporary buildings are allowed during development.
- Building & construction standards: Exterior walls must be stucco, brick, stone, wood, or compatible materials; roofs must be wood, slate, or asphalt per pitch. Minimum finished floor area is 1,800 square feet. Construction must start within 6 months of deed and finish within 6 months of start.
- Architectural & exterior changes: All plans for residences and exterior structures must be approved by the Developer (pre-completion) or by an Architectural Committee (post-completion). Changes to exterior colors, additions, or alterations also need approval. Decisions not acted upon within 45 days are deemed approved.
- Exterior structures: Fences, basketball goals, play structures, pools, and doghouses require Architectural Committee approval. Fences must be of approved design, no chain link. Basketball goals must be freestanding with clear or white backboards. Pools require fencing. Doghouses no larger than 5'x5', placed near residence.
- Vehicles & parking: No trailers, campers, boats, or similar vehicles may be parked in yards. They may not remain in driveways or streets for more than 24 hours. Automobiles, pickups, and vans should be kept in garages when possible. Garage doors must stay closed except for entry/exit.
- Animals & pets: No livestock or poultry; only common household pets (dogs, cats) are allowed, not for commercial purposes. Maximum of three dogs or cats (or combination) per lot.
- Landscaping & maintenance: Lawns must be fully sodded within 5 months of construction start; zoysia grass prohibited. Lawns must be mowed to no more than 4 inches. Vegetable gardens only in back yards. Lots must be kept neat and clean; all structures maintained in good repair.
- Prohibited activities & nuisances: No noxious or offensive activities; no business use except home offices allowed by city ordinance. No high-intensity lighting above residence. No exterior antennas, satellite dishes, or clotheslines (unless court restricts). Damaged buildings must be repaired within 3 months.
