Pecos Vistas II is a single-family home community in Chandler, AZ, governed by a homeowners association (HOA). All owners automatically become members of the association, which maintains common areas (including private streets and landscaping) and enforces the rules set out in this Declaration of Covenants, Conditions and Restrictions. The covenants run with the land for 20 years and automatically renew.
- What you own & maintain: You own your lot and the house on it, and are responsible for all maintenance, repairs, and landscaping on your lot (including roofs and both front and rear yards). The HOA maintains the common areas (private streets, retention areas, landscaping in open spaces).
- Leasing & rentals: Leases must be in writing, for a minimum term of 30 days, and cover the entire residence and lot. You must notify the board of any lease and provide the tenant's name, lease term, and your current address.
- Pets: Only a reasonable number of generally recognized house or yard pets are allowed, kept solely as domestic pets. They must be leashed (leash no longer than 6 feet) when off your lot, and you must immediately remove droppings. Pets cannot be a nuisance.
- Architectural review: Any exterior alteration (including painting, additions, sheds, landscaping changes, solar panels, and basketball goals) requires prior written approval from the Architectural Committee. The committee has 60 days to respond; if no response, approval is deemed granted. A consultant fee may be charged.
- Parking & vehicles: Vehicles must be parked in garages or driveways. No vehicles exceeding ¾ ton, boats, RVs, or trailers may be parked so they are visible from neighboring property, common areas, or streets. Parking on one side of the private street is prohibited. Only operating vehicles may be parked in driveways.
- Business use: Lots are for single-family residential use only. A home occupation is allowed if it is not detectable from outside, conforms to zoning, does not involve customer visits (except mail/parcel delivery), and does not create a nuisance. Leasing an entire residence is not considered a business.
- Assessments: The HOA levies annual assessments, initially capped at $580 per lot (for once-occupied lots; never-occupied lots pay 25% of that). The cap can increase each year by the CPI change or 20%, whichever is greater. The board may also levy special assessments approved by two-thirds of members. Delinquent assessments accrue interest (12% per year) and a $15/month late fee, and become a lien on the lot.
- Occupancy limits: A 'single family' is defined as one individual, a group of related persons, or up to three unrelated persons living together as a common household. No more than three unrelated persons may occupy a dwelling.
