Gilbert and Pecos Well Owners Association is an unsubdivided residential community in Phoenix where owners hold fee title to individual parcels but are bound by mutual covenants requiring single-family construction, maintaining property standards, sharing road and water infrastructure costs, and paying annual assessments.
- What you own & maintain: You own your individual parcel in fee simple on unsubdivided land. You must keep your property in good, clean, finished condition free of weeds, refuse, and unsightly objects; the Association can enter and correct violations at your expense if you don't within 10 days of notice.
- Residential use only: Property is restricted to single-family, on-site-constructed homes only—no manufactured homes. Minimum 1,800 livable square feet with a two-car garage required.
- Roof requirements: Roofs must use wooden shake, concrete, slate, clay tile, or pueblo style lines—no exposed composition shingles or rolled roofing permitted.
- Water service & restrictions: The Association provides water service and meters each lot. You cannot fill or refill swimming pools (evaporation replacement only) or use bubbler/flood irrigation for trees; drip irrigation is allowed. Monthly water use is billed separately; nonpayment can result in water disconnection and suspension of voting rights.
- Road maintenance & costs: The community shares a private gravel road; all maintenance costs split equally among owners. Repairs require approval from all parties and joint funding—only minimal improvements (gravel, grading) on an as-needed basis are expected.
- Annual & special assessments: Annual assessments require majority member approval and are based on the Association's costs; if no budget passes, the prior year's amount plus up to 20% is levied. Special assessments up to 20% of the annual budget can be imposed without a vote; larger ones require member approval and are payable over up to 10 years. Late payments incur a penalty of the greater of $15 or 10% of the unpaid amount, plus 18% annual interest.
- Voting rights: Each owner gets one vote for every 1/10 acre (or majority fraction) of their lot. Voting rights are suspended if water use assessments fall delinquent.
- Duration & amendment: The restrictions run for 40 years from the 1998 recording and can be amended or terminated only by written consent of owners holding 75% of the total property acreage.
