If the board disapproves but does not exercise the option, the transfer is valid only if the instrument records either board approval, an affidavit of failure to act, or written approval from owners of at least half of the lots.
- Term of restrictions: The restrictions run for 10 years from recording (1964), then automatically renew for successive 5-year terms unless terminated or amended by an instrument signed by at least 75% of lot owners, recorded within 90 days before expiration.
