Summerfield Units 1 & 2 is a 140-unit condominium community in Phoenix, AZ. These Bylaws (as amended in 1993) govern the homeowners association, its board, and all unit owners. The rules apply to owners, tenants, guests, and invitees, and cover assessments, maintenance, pet limits, parking, architectural changes, and general conduct.
- What you own & maintain: You own your unit's interior and internal installations (water, light, gas, HVAC, plumbing, doors, windows, etc.). The association is responsible for common elements and common area maintenance. Owners must promptly repair anything within their unit that could affect the property, and reimburse the association for damage caused by them or their guests.
- Assessments & fees: Each owner must pay monthly and special assessments, which are secured by a continuing lien on the unit. Monthly assessments are due by the 1st, delinquent after the 10th. Late charges are at least $10, plus interest at a rate set by the board. The board may also impose fines for violations, which are also secured by a lien.
- Pets: Up to two household pets (e.g., dogs or cats) are allowed per unit, but not for commercial breeding or maintenance. Pets must comply with Scottsdale city ordinances. The board may adopt additional pet rules.
- Parking & vehicles: Each unit is assigned one covered carport space and the space directly behind it. Parking is allowed only in assigned or marked spaces. Boats, trailers, campers, and non-standard vehicles may be parked temporarily for no more than 4 hours in any 48-hour period (loading/unloading excepted). Violations may result in towing.
- Architectural review: No structural modifications, exterior alterations, painting, fences, patio covers, or installations (e.g., satellite dishes, solar panels, air conditioning units) may be made without prior written approval from the Architectural Committee or board. The committee must respond within 30 days; failure to respond is deemed approval. No exterior clotheslines are permitted.
- Leasing & rentals: This document does not specify a minimum lease term or leasing restrictions (other than requiring owners to submit a Unit Registration Form and tenant acknowledgment of rules within 15 days of tenancy). Refer to the Declaration for any leasing limitations.
- Board & meetings: The board consists of 5 directors, each serving 2-year terms (no more than one director per unit). Annual meetings are held in September. Special meetings can be called by the board or by petition of 1/3 of owners. Board meetings occur at least 6 times per year. Owners may inspect association books and records upon reasonable request.
- What this document doesn't cover: These Bylaws do not include the full Declaration of Horizontal Property Regime, which may contain additional restrictions on leasing, age, or use.
