What Hallcraft Villas West Nine's governing documents say
Hallcraft Villas West Nine is a townhouse community in Phoenix, Arizona, where you own your individual unit attached to neighbors via shared party walls. The association maintains common areas and exterior elements, funded by per-unit assessments starting at $325 annually.
- What you own & maintain: You own your unit's interior, individual patio, and associated property; you're responsible for upkeep, maintenance, termite control, and all fixtures/equipment. The association handles exterior maintenance (roofs, gutters, siding, landscaping, walkways), but not glass surfaces.
- Party walls & shared maintenance: Walls between units are shared; you and your neighbor split repair costs proportionally. If a wall is damaged by nature (not negligence), you both pay equally. If your negligence exposes a wall to the elements, you pay the full protection cost. Disputes go to binding arbitration.
- Assessments & fees: Annual assessment starts at a maximum of $325 per unit. Increases up to 3% per year require no vote; increases above 3% need a two-thirds member vote. Special assessments for capital improvements also require a two-thirds vote. Delinquent assessments (over 30 days late) accrue 6% annual interest and create a lien on your property.
- Architectural review: Any building, fence, wall, or exterior change requires written board approval for design harmony and location appropriateness. The board has 30 days to approve or deny; if no response, approval is deemed granted.
- Use restrictions: Units are for residential use only—no business activities or livestock. Household pets (dogs, cats) are allowed, but not for commercial purposes. One 5-square-foot 'for sale' or 'for rent' sign per lot is permitted. Trash, clotheslines, and equipment must be screened from neighboring units.
- Parking & vehicles: Each lot includes one permanently assigned automobile parking space. No abandoned or inoperable vehicles may be stored on the property.
- Utilities & water: The association provides water for household use and landscaping. Utility lines (sewer, gas, electricity, telephone) are subject to easements; the association can enter your lot to repair/maintain shared sewer facilities. Minor construction overhangs up to 1 foot are permitted.
- Governance & membership: Lot owners hold voting membership; each owner has one vote per lot. The original declarant held elevated voting power during a transition period (first two years or until Class A votes equaled their votes); this has long since converted to standard single-vote membership.
