What Mallcrapt Villas East Four's governing documents say
Mallcrapt Villas East Four is a 209-unit condominium in Phoenix, Arizona, where you own your individual apartment unit and hold a 1/209 undivided interest in shared common elements. The association maintains all common areas and exteriors, funded by monthly pro-rata assessments from each unit owner.
- What you own & maintain: You own your individual unit's interior. The association maintains the building exteriors, roofs, common grounds, recreational facilities (including the swimming pool), parking areas, and utilities infrastructure. Individual owners remain responsible for their own unit's electricity, plumbing, and water service.
- Parking: Two parking spaces are allocated to each apartment unit as limited common elements.
- Monthly assessments: Each unit pays an equal monthly assessment calculated as 1/209 of the association's total annual costs for common area maintenance, recreational facilities, fire/hazard insurance, and reserves. If an assessment is not paid within 20 days of the first of the month, it becomes a lien on your unit.
- Leasing & rentals: You must notify the Board in writing before accepting any offer to purchase, lease, or rent your unit. Association members have 15 days to submit an identical offer; if they do, you must accept theirs in preference. Exception: Rentals for less than one year are completely exempt from this right-of-first-refusal requirement.
- Residential use only: The property is restricted to residential use. No business activities of any kind are permitted.
- Exterior modifications & signs: One "For Rent" or "For Sale" sign per unit is allowed (not exceeding 5 feet square). No exterior TV or radio antennas without Board approval. Fences, hedges, walls, clotheslines, garbage cans, and service equipment require approval or must be screened.
- Insurance & damage liability: The association obtains fire/hazard and public liability insurance covering full replacement cost. If your unit is damaged through your negligent act, you must repay repair costs (becoming a lien if unpaid within 10 days). If insurance proceeds are insufficient for repairs, the association may levy a special assessment.
- Pets: Domestic animals are permitted, subject to regulations adopted by the association.
