This is the Condominium Declaration for the Hanover Mill Avenue Garage Condominium in Phoenix, AZ — a condominium community where each unit is a parking space within a multi-level parking garage. Owners own their parking unit and a 1/47th undivided interest in the common elements (drive lanes, structural components, etc.), which the association maintains, insures, and operates subject to a separate Parking Agreement.
- What you own & maintain: You own your parking unit (identified on the plat) and an equal 1/47th share of the common elements. The association is responsible for maintaining, repairing, and replacing all common elements (drive lanes, structural components, utility systems, etc.) in accordance with the Parking Agreement. You cannot alter your unit or common elements without board approval.
- Use & restrictions: Units may only be used for parking motor vehicles. No personal property, storage, or machinery/equipment is allowed in any unit. No nuisances, offensive activity, or unlawful uses are permitted. All laws and zoning ordinances apply.
- Alterations & improvements: No improvements, alterations, or modifications to any unit or common element may be made without prior written approval of the board of directors. This includes any changes to unit boundaries (which may be relocated by amendment with board approval).
- Assessments: Regular assessments are based on the annual budget adopted by the board, divided equally among all units (each unit has a 1/47th common expense liability). Special assessments require approval of 67% of owner votes (except for certain capital improvements after damage). Assessments are due as set by the board; unpaid amounts become a lien on the unit.
- Insurance: The association must maintain property insurance on the common elements and units, general liability insurance (at least $1M per occurrence), workers’ compensation, and directors & officers liability insurance. Owners may obtain their own liability insurance for their unit.
- Enforcement & violations: The association can enforce the declaration through any legal remedy, including liens, fines, and attorney’s fees. Owners are responsible for their own conduct and that of their authorized users. The board has discretion not to pursue enforcement if it deems it not in the association’s best interest.
- Parking Agreement: The community is subject to a recorded Parking Agreement that grants certain parking easements to third parties (e.g., retail and the City). The association will eventually assume the declarant’s rights and obligations under that agreement. In case of conflict between the Parking Agreement and this declaration, the Parking Agreement controls.
