J-Bar-1 Ranches is a rural residential subdivision in Phoenix, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs) recorded in 1985. It covers about 1,278 acres, with parcels generally a minimum of 5 acres. Owners automatically become members of the homeowners association and are subject to its rules, assessments, and architectural controls.
- Association membership & assessments: Each parcel owner automatically belongs to the association and gets one vote per parcel (developer had extra votes until 1992 or until voting parity). Annual assessments are set each December, due by February 28, and can be paid in installments. Special assessments may also be levied. Unpaid assessments become a lien on the parcel, bearing 18% interest, and can be foreclosed.
- Prohibited uses & nuisances: No heavy commercial, wrecking yards, or storage yards. No noxious or offensive activity, nuisance noise, or accumulation of trash or derelict vehicles. Outside fires must be confined to protected areas and attended. Firearm use must not endanger people, domestic animals, or property.
- Temporary structures & occupancy: No trailer, motor home, tent, camper, shack, or temporary building may be lived in for more than six months total, unless the owner is building a permanent home. This does not apply to mobile/manufactured homes that comply with county regulations.
- Architectural review & improvements: All buildings, fences, and other improvements require prior approval by the Architectural Control Committee (initially two named individuals, later five elected members after 75% of parcels sold). Plans must be submitted at least 30 days in advance. Structures must be set back at least 75 feet from roadways and 50 feet from property lines. Fences over 4 feet and any buildings must meet setback requirements. Cattle guards or gates required where fences cross easements.
- Animals & livestock: Horses, livestock, fowl, poultry, and domestic pets are permitted in reasonable numbers. All animals must be kept in a good husbandlike manner, with proper fencing. Hogs, pigs, goats, and sheep must be kept at least 100 feet from adjacent parcels or roads. Chickens or poultry exceeding 50 must be at least 200 feet from boundaries. Pets must be controlled to avoid hazards.
- Maintenance & sanitation: All improvements must be kept in good repair and painted/finished. Corrals and stables must be clean and free of excessive manure or odors. Sanitation must use septic tanks or other county-approved systems.
- Enforcement & violations: The association can enter a parcel to correct violations after 30 days' written notice (or immediately in an emergency). Costs become a lien. Owners in arrears more than 14 days may have voting and other privileges suspended. The association or any member (after demanding enforcement) can sue and recover attorney's fees.
- Duration & amendments: The CC&Rs last for an initial 10 years from recording (1985), then automatically renew for successive 10-year terms. They can be revoked by a 3/4 vote of all members.
