This is an amendment to the Declaration for Kaufman and Broad at Arizona Hillcrest, a Phoenix master-planned community, focusing on developer and builder rights during the development phase. It gives the developer disproportionate voting power (3 votes per lot vs. 1 for regular owners), exempts them from assessments while requiring them to fund budget shortfalls, and permits unrestricted construction of development infrastructure. This is a partial, technical amendment — the full community rules appear in the original Declaration.
- Developer & builder voting power: During development, Kaufman and Broad (the Declarant) and designated builders have 3 votes per lot owned, while regular owners have 1 vote each. This developer advantage converts to standard membership on whichever comes first: 120 days after regular owners' votes equal the developers' votes, 20 years from the original Declaration, or when the developer voluntarily relinquishes status.
- Developer exemptions from assessments: The Declarant and designated builders don't pay regular assessments on lots they own, but the Declarant must contribute cash, goods, or services to cover any shortfalls in the association's budget — capped at what those assessments would have cost.
- Committee membership & governance: While Kaufman and Broad owns property, they appoint all committee members. After, the Board appoints them — but previously appointed designated builders remain members as long as they own property. Designated builders cannot be charged committee fees without written consent.
- Developer construction rights: The Declarant and designated builders can construct model homes, sales offices, equipment yards, signs, and construction trailers without restriction from the deed covenants — all as determined in their sole discretion.
- Assessment timing & owner transfers: Assessments begin when a lot is first sold to a buyer and are prorated from that date. Previous owners remain liable for any unpaid assessments accrued before transfer.
- Enforcement, costs & liens: The association can enforce the Declaration and recover costs including attorney fees; these costs accrue 12% annual interest and create a lien on the property.
