Kierland Commons is a master-planned mixed-use commercial and residential development in Phoenix, Arizona, governed by a parcel declaration. It binds property owners (Tract owners) who develop and operate commercial, retail, office, hotel, museum, and residential buildings on designated parcels, coordinating development and maintaining shared Common Areas like drives, parking, utilities, and landscaping through the Declarant and later an Association.
- Permitted uses: Tracts can be developed for commercial use (retail, office, restaurant, hotel), a museum (for designated area), or residential (up to a specified number of units, rentable or owner-occupied). No other uses are allowed.
- What you own & maintain: You own your individual Tract and Building; you maintain the building exterior, appurtenant utilities, and limited common areas (trash storage, etc.) to first-class standards. The Declarant maintains shared Common Areas (Private Drives, parking, lighting, landscaping, utilities) to high-quality mixed-use commercial standards.
- Construction & design approval: All Buildings must fit within designated Building Areas and Floor Area limits on the Site Plan. You must submit detailed exterior designs for Declarant approval before construction; Declarant sets architectural standards, colors, and materials. Common Area improvements must be substantially completed when your building's first tenant opens for business.
- Parking requirements: Until 50,000 sq ft of buildings are occupied community-wide, each Tract must maintain sufficient parking to meet City requirements as if it were a standalone property. Parking spaces cannot be reduced below the Site Plan amount without Declarant approval.
- Utilities & easements: All utility lines must be underground (except transformers, hydrants, and equipment). Owners grant each other perpetual easement rights for utilities, storm drainage, and subsurface construction (piers/footings) under adjoining Tracts, with 30 days' notice required before use.
- Common area maintenance & owner costs: The Declarant maintains Common Areas and prepares annual Shared Expense budgets; each owner pays a Pro Rata Share based on their Tract's area, due monthly. Annual reconciliation is provided within 150 days; overpayments are refunded and underpayments are due within 30 days.
- Phased development & governance: Development occurs in phases at Declarant's discretion. Initially managed by the Declarant (PHXAZ Limited Partnership), management transfers to a community Association at a future Transfer Date.
