Kitchell Business Centre is a commercial/industrial park in Phoenix, AZ — each parcel is owned individually, but all owners share common areas through an association (Kitchell Business Centre Owners' Association). The rules apply to all parcel owners and their tenants. This document sets the basic covenants for use, maintenance, architectural control, and assessments. It does not cover residential occupancy or amenities.
- Permitted use: All parcels must be used only for commercial or business purposes consistent with existing zoning. Uses must not be offensive (odors, noise, pollution) or hazardous. No junk or salvage yards.
- Architectural review: No building, sign, fence, parking lot, or exterior alteration may be made without Board approval. Plans must be submitted and reviewed within 30 days (with possible extensions). Standards cover design harmony, materials (e.g. no unfinished concrete block or metal buildings), color, and screening of equipment and storage.
- Parking & loading: Adequate off-street parking must be provided for each site; on-street parking is not allowed for ordinary use. Driveways and parking areas must be paved. Loading areas must be screened from view.
- Signs & advertising: No signs may be placed without Board approval and required city permits. Signs must conform to design guidelines. No advertising visible outside buildings (e.g. flashing lights, loudspeakers) without Board consent.
- Assessments & liens: Each owner pays regular and special assessments levied by the Board. Assessments are based on parcel square footage (or another reasonable method). Unpaid assessments become a lien on the parcel and can lead to late charges (1.5% per month interest) and foreclosure.
- Maintenance responsibilities: Owners must maintain their parcels, including landscaping, parking, exterior walls, roofs, and public right-of-way adjacent to the parcel. If an owner fails to maintain, the Association may do the work and specially assess the cost as a lien.
- Easements & common areas: Mutual, nonexclusive easements grant all owners ingress/egress over driveways and sidewalks. Utility easements exist for water, sewer, power, etc. The Association maintains common areas (landscaping, parking, signs) and carries liability insurance.
