What Kitchell Skypark Condominium II's governing documents say
Kitchell Skypark Condominium II in Phoenix is an industrial/office condominium where you own an individual commercial building and share ownership of common facilities maintained by the association. All units are strictly restricted to non-residential, industrial/office use — this is a commercial property, not a residential community. Monthly assessments, due the 1st of each month, fund the association's operation of common elements.
- Use restriction: All buildings are restricted to industrial/office, non-residential use only and must comply with existing zoning. Residential use is not permitted.
- What you own & maintain: You own your individual commercial building (unit). The association maintains all common elements, including shared structures and grounds, at its expense.
- Monthly assessments: Common expenses are assessed each month (due on the 1st) in proportion to your building's square footage relative to all buildings in the condominium. The association holds a lien on your building for any unpaid assessments.
- Voting & governance: Each building receives votes in the association equal to its share of common element interest (based on square footage). The developer controls the board initially (up to 4 years); afterward, a board of 3–6 directors is elected by owners.
- Building boundaries: Your building extends from the bottom of the concrete slab below to the topmost exterior surface of the roof, bounded by the exterior perimeter walls. This includes any heating, hot water, and air conditioning systems exclusively serving your building.
- Parking: Parking spaces within the condominium can be assigned as limited common elements by the board of directors and distributed to specific building owners.
