All owners are automatically members of the LeBella Casa Planned Community Association and are bound by the rules in this declaration.
- What you own & maintain: You own your lot and the interior of your home. You are responsible for maintaining the interior, roof, exterior walls, patios, private yards, landscaping, windows, and all fixtures within your lot boundaries. The association maintains common areas including landscaping, sprinkler systems, swimming pool/spa, exterior walls of common areas, and pays for utilities not individually metered.
- Assessments: Every owner pays annual and special assessments at a uniform rate per lot. The initial maximum annual assessment is $360 per lot (adjustable by CPI increase each year or by a 2/3 vote of members for larger increases). Special assessments for capital improvements require a 2/3 vote. Assessments become a lien on the lot if unpaid, and the association can foreclose.
- Architectural review: No building, fence, wall, patio cover, antenna, or other exterior structure or alteration may be made without written approval from the board or its architectural committee. Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed given.
- Use restrictions: All lots are restricted to residential use. No temporary structures, trailers, tents, barns, or outbuildings are allowed. No animals may be raised or bred commercially; dogs, cats, and other household pets are allowed in reasonable numbers but must not be a nuisance. No activity that creates a nuisance or interferes with quiet enjoyment is permitted.
- Parking & vehicles: Vehicles may not be parked on common areas except in designated visitor parking. No abandoned or inoperable vehicles may be stored on any lot where visible from other lots or streets. Boats, campers, and mobile homes may be kept on the owner's premises.
- Leasing & rentals: Leases are allowed but must include a written agreement that the lease is subject to the declaration, articles, bylaws, and association rules. Failure of the tenant to comply is a lease default.
- Party walls: Walls built on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. Disputes go to the board for binding decision.
