This document is a Declaration of Restrictions for Mobile Ranchos Unit Seven, a single-family home subdivision in Phoenix, AZ. It establishes restrictive covenants that run with the land, binding all lot owners. Key points include mandatory membership in the homeowners association, architectural review requirements, and restrictions on livestock, parking, and lot usage.
- Architectural review: No building, fence, or other improvement may be constructed or altered without prior written approval of the Company (H.C. Augustine or successors). Plans and specifications must be submitted, and if no response within 30 days, approval is deemed granted.
- Livestock & horses: No horses, livestock, or fowl are allowed on most lots. However, on Lots 1 through 33, up to two horses are permitted, subject to conditions: barns and corrals must be kept clean, horse easements and bridle paths must remain open, and corrals must be at least 25 feet from the back property line and no horses within 52 feet of the front street.
- Single-family use: Each lot may be used for a single-family residence only. Only one single-family living unit is allowed per lot, though a small vacation trailer may be stored if it does not detract from the appearance.
- Parking & vehicles: No boats, boat trailers, travel trailers, or similar property may be stored on any lot without prior consent. Pickup trucks or similar non-commercial vehicles are permitted unless deemed detrimental by the Company. No machinery, junk cars, dump trucks, stake trucks, vans, building materials, or debris may be parked or stored on lots or streets. No washing machines or other appliances may be kept outside. No shortwave radio equipment or aerials may be erected without consent.
- Signs: No 'For Sale' or 'For Rent' signs may be posted except those by the Company, which will handle resale advertising at cost to the owner.
- Lot subdivision: No lot may be resubdivided into smaller lots or conveyed in less than its original full dimensions, except for contiguous lots combined into a single parcel with equal or greater street frontage. Dedication for public utilities is permitted, and the remainder is treated as a whole lot.
- Enforcement & duration: The restrictions run with the land until January 1, 1983, and automatically extend for successive 10-year periods unless a majority of owners agree to change them. Violations may be enforced by injunction or damages, and the prevailing party is entitled to reasonable attorney fees and court costs. Failure to enforce does not waive future enforcement.
