This Declaration of Covenants, Conditions, Restrictions and Easements establishes a homeowners association to manage the well, common pipeline, and road, and sets rules for water use, landscaping, and assessments. It is primarily an infrastructure governance document rather than a full HOA rulebook.
- Shared well & water system: All lot owners share a common well and pipeline. Each lot may tap into the common pipeline for water via an individual water line (one per lot). The association owns the capital improvements (well, pump, pipeline).
- Assessments for well & road: Monthly assessments cover operating costs (electricity, testing, insurance) and capital expenditures for the well and common pipeline. Initial monthly assessment is $19.00, adjustable. Road maintenance costs may also be assessed separately. Assessments are due monthly on the 1st.
- Water use restrictions: Water from the well is for private domestic use only: consumption, household needs, minor landscaping, small gardens, livestock, and ponds/pools with impervious liners. No watering lawns, no farming, no filling pools over 500 gallons from the well. No selling or sharing water off the lot.
- Landscaping restrictions: Only xeriscape landscaping is permitted, except small vegetable, herb, or flower gardens. The association may allow limited trees and bushes by majority vote.
- Road maintenance: The association (or declarant) may set rules for maintaining the roadway, including assessing costs. The road may be dedicated to a government entity if a majority of lot owners vote and if it doesn't violate zoning.
- Easements & access rights: Blanket easements exist over the well site and roadway area for utilities, drainage, and maintenance. The association has an easement to enter lots (excluding building interiors) for inspections and to correct violations. Lot owners must give reasonable notice for non-emergency access.
- Option to withdraw from well obligations: A lot owner who stops using well water can stop paying well-related assessments by giving notice to the association and ceasing water use. They remain liable for roadway and administration costs.
