Montelucia Villas is a single-family detached villa community within the larger Montelucia Resort in Paradise Valley, AZ. The property is governed by a Declaration of Covenants, Conditions, Restrictions and Easements that binds all villa owners. Living here means you own the villa interior but the Declarant (resort operator) maintains exteriors, common areas, and provides services—all funded by assessments. This is a resort-integrated community with strict rules on use, appearance, and conduct.
- What you own & maintain: You own the interior of your villa, its private yard, and its garage. The Declarant maintains the roof, exterior walls, driveways, landscape (except private yards), perimeter walls, gates, signage, and common utilities. You must maintain everything else to a high 'Resort Standard.'
- Leasing & rentals: You may lease your entire villa only. Leases must be in writing, specifically subject to this Declaration and all rules, and a copy must be provided to Declarant within 10 days of signing. No short-term rentals are explicitly prohibited, but the lease must be of the entire villa.
- Pets: Only usual household pets (dogs, cats, birds) are allowed in reasonable numbers as specified in the Rules—which may set maximum sizes, prohibited types, and other limits. No outdoor pens or houses. Pets must be under control, and waste must be promptly removed from shared areas.
- Architectural & exterior changes: Any exterior alteration, improvement, landscaping, or change in paint color requires prior written approval from Declarant (in its sole discretion, except non-structural changes inside private yards must not be unreasonably withheld). - Parking & vehicles: Parking priority: first in your villa's enclosed garage, then on the driveway, then in allocated special parking spaces. No parking on private accessways except for designated spaces, emergencies, or approved moving vans. Commercial vehicles, trailers, boats, and inoperable vehicles are prohibited except temporarily in garages. Additional parking beyond two free spaces may be arranged for a fee.
- Assessments & fees: Each villa pays a 1/34 share of costs for common facilities and services, plus individual charges for exterior maintenance, services, and transfer fees. Invoices are due 30 days after sent; late charge 6%, then interest at Prime +4% or 10% per annum. Assessments are secured by a lien on the villa. An annual in-lieu payment of $3,176.47 to the town is also passed through.
