What Montierra at Shadow Mountain's governing documents say
This is a partial document consisting of mortgagee consents, owner consents, and a Fourth Amendment to the Declaration of Covenants, Conditions, and Restrictions for the Montierra at Shadow Mountain community (a condominium/townhome development in Phoenix, AZ). It is not a complete rulebook — it only summarizes four key changes from the amendment. The full governing documents would contain additional rules.
- What you own & maintain: The Association maintains all Common Area (property outside the exterior unit lines). Unit owners are responsible for everything inside those lines — the amendment clarifies the Association no longer maintains any interior property.
- Parking & vehicles: No parking is allowed in any unit driveway, on sidewalks, or along private streets. However, visitors may temporarily park along private streets.
- Voting rights: The Declarant (builder) retains Class B membership with three votes per unit it owns, extended until the earlier of when Class A member votes equal three times the Declarant's votes, or December 31, 1993.
- Assessments: The procedure for setting the maximum annual assessment is unchanged. For calendar year 1992, the maximum annual assessment per unit is $180.
- What this document doesn't cover: This document does not provide rules on pets, leasing, architectural standards, age restrictions, or other typical HOA/condo regulations. Those would be found in the full Declaration and other governing documents.
