Northern Manor Two is a townhome community in Phoenix, AZ — each home shares party walls with neighbors, and there is an association (Northern Manor Unit Two Townhouse Association) that maintains common areas and provides exterior maintenance, funded by assessments levied per lot.
- What you own & maintain: You own the interior of your townhouse and individual patios; the Association maintains roofs, gutters, exterior surfaces, trees, shrubs, walks, and other exterior improvements (excluding glass). Termite control is your responsibility.
- Assessments: Annual and special assessments are levied per lot at a uniform rate. Initial maximum annual assessment was $420 per lot, with increases capped at 3% per year without a membership vote. Delinquent assessments bear 6% interest and become a lien on the property.
- Party walls: Walls constructed on the dividing line between townhouse units are party walls. If damaged by one owner, that owner must repair at their own cost; if damaged by other causes, adjoining owners share cost equally. Modifications to party walls require the adjoining owner's written consent.
- Architectural review: No exterior changes, additions, or new structures (including fences, hedges, walls) may be made without written approval from the Board or an architectural committee. Plans must be submitted and approved within 30 days, or approval is deemed given.
- Use restrictions: All lots are for residential use only. No business activities, commercial vehicles, or inoperable vehicles visible from other lots or streets. Clotheslines must be confined to patios. Advertising signs limited to one 'for rent' or 'for sale' sign of no more than 5 square feet per parcel.
- Pets: Dogs, cats, and other household pets are allowed but may not be kept, bred, or maintained for commercial purposes.
- Voting & membership: Each lot owner is a member with one vote per lot. The Declarant initially had three votes per lot (Class B membership), which converts to Class A when Class A votes equal Class B votes or after five years. Voting rights may be suspended for nonpayment or rule violations.
- Damage & rebuilding: If a townhouse is damaged or destroyed, the owner must contract for repairs within 60 days and complete them within six months. If they fail, the Association may repair and place a lien on the lot. Disputes go to arbitration.
