This is the Declaration of Covenants, Conditions, Restrictions and Easements for Northsight Village III, a commercial and mixed-use development in Phoenix, AZ. The document governs the rights and obligations of owners of parcels (buildings) within the development, covering shared common areas, assessments, maintenance, permitted uses, and design standards. It applies to property owners, tenants, and their Permittees (employees, customers, etc.), not to residential homeowners.
- Permitted uses: Parcels may be used for offices, commercial businesses, retail, auto service and repair, restaurants, bars and nightclubs, open retail, parking, and accessory uses. Other uses require Declarant approval. All uses must comply with Scottsdale City Code.
- Assessments & fees: Declarant levies annual and special assessments on each parcel based on gross building area. Assessments fund common area maintenance, reserves, and operations. Late payments incur a 5% late charge after 15 days and interest at 10% per annum after 30 days. Delinquent assessments become a lien on the parcel.
- Maintenance responsibilities: Declarant maintains common areas (landscaping, hardscape, sidewalks, parking lots, storm water tanks, trash areas, etc.). Each owner maintains its own building interiors/exteriors and 'Excluded Areas' (walkways, parking, drives within its parcel). Owners may step in if Declarant fails to maintain common areas, with reimbursement.
- Parking & access: All parking spaces are on a non-exclusive, first-come-first-served basis for owners, tenants, and Permittees. No owner may close or segregate parking without Declarant consent. Owners maintain parking areas on their own parcels.
- Architectural & design review: All exterior improvements, modifications, signage, and landscaping require prior written approval of Declarant. Plans must be submitted; approval is not unreasonably withheld. Interior non-structural changes do not require approval.
- Party walls: Shared walls between adjoining buildings are party walls. Owners have equal use rights. Damage caused by an owner's act is repaired at that owner's cost; damage from other causes is shared proportionally by frontage. Disputes are decided by Declarant.
- Use restrictions & nuisances: No nuisance activities, odors, loud noises, or exterior speakers (except security). Trash must be in approved covered containers. No antennas or billboards without Declarant approval. No further subdivision or rezoning without consent.
- Term & amendments: The Declaration runs for 65 years from recording (2016), with automatic 10-year renewals unless all owners and lenders agree to terminate. Amendments require written consent of Declarant and all owners.
