What Northsight Center's governing documents say
Northsight Center is a commercial condominium project in Scottsdale, AZ — you own your unit and an undivided share of the common elements, which the association maintains and insures. All units are restricted to automotive repair, light manufacturing, showroom sales, and professional/office use; no residential use is permitted. The document establishes the framework for ownership, governance, and use of the property, and applies to unit owners and their tenants.
- Use restrictions (no residential): Units may only be used for automotive repair, light manufacturing, showroom, showroom sales, and professional/office activities. Residential use is expressly prohibited. No noxious, offensive, or hazardous activities are allowed.
- Architectural control: All exterior changes, signs, and structures require prior written approval from the Board of Directors (acting as Architectural Control Committee). Plans must be submitted, and the Board has up to 60 days to approve or disapprove. Specific design guidelines cover building materials, colors, roof equipment, parking, refuse screening, and more.
- Parking & vehicles: Adequate off-street parking must be provided. Overnight parking must be within fenced areas. All driveways and parking areas must be paved. The Board may prohibit vehicles that are noisy, unsightly, or nuisance-creating.
- Assessments & fees: Annual assessments are levied based on each unit's undivided interest in the common elements. Special assessments require a 60% vote of total voting interests. Unpaid assessments bear interest at 18% per year and are secured by a lien on the unit.
- Maintenance responsibilities: Unit owners maintain the interior of their units, including HVAC systems. The association maintains the exterior walls, roof, common elements, and limited common elements (e.g., assigned parking spaces, entryways). The association also carries master property and liability insurance, with at least $1M per occurrence.
- Signs: No signs are allowed except a 'dignified' name and/or address sign, subject to Board review and approval. Sign placement must comply with city ordinances.
- Compliance & enforcement: All owners must comply with the Declaration, Bylaws, and association rules. Violations may result in fines, injunctions, or damage actions. The association may recover costs and attorneys' fees in enforcement actions.
- Insurance requirements: The association must maintain multi-peril property insurance covering the building and improvements, plus public liability insurance of at least $1,000,000 per occurrence. Units owners may be required to provide proof of coverage upon request.
