This is a condominium declaration for The Villages Office Suites in Phoenix, AZ, a commercial condominium where you own an office unit and share common elements. The rules primarily bind unit owners, and the document is aimed at commercial office users, not residents. It does not allow residential use; only professional offices and limited support services (up to 10% of building square footage) are permitted.
- Permitted use: Units must be used as offices for professional services (medical, dental, law, etc.). Up to 10% of a building's gross square footage may be used for support services like newsstands, coffee stands, cafés, dry cleaning drop-off, copy shops, and similar, with Board approval. A different use requires zoning compliance, 67% owner approval, and Declarant approval during the Period of Declarant Control.
- Exclusive use restriction (renal dialysis): As long as MOD RE HOLDINGS, LLC operates a renal dialysis center on at least 7,500 sq ft of Building C, no other owner or occupant may operate a renal dialysis center anywhere in the condominium. This restriction expires automatically when MOD RE ceases that operation.
- Pets: No animals, birds, fowl, poultry, or livestock may be kept. Small pets, such as cats and dogs, are permitted on a daily basis (no overnight or continuous presence implied).
- Leasing & rentals: Leases must be in writing and expressly subordinate to the Declaration and Rules. At least 10 days before lease start, the unit owner must provide the Association with lease dates, lessee names, owner contact info, and an emergency contact. The owner must give the lessee copies of the Declaration and Rules and remains liable for violations by the lessee or invitees.
- Signs: No signs of any kind may be displayed on the exterior of a building or visible from the exterior without prior Board approval. The Board may permit signs identifying the unit owner, lessee, or occupant if location, size, color, and appearance are acceptable. All signs must also comply with Town of Queen Creek ordinances.
- Parking & vehicles: Motor vehicles may be parked only in designated parking spaces. No inoperable vehicle may be stored or parked. No construction, reconstruction, servicing, or repair of vehicles is allowed on any portion of the condominium (except emergency repairs). The Board may have unauthorized vehicles towed at the owner's expense.
- Assessments and fees: Common Expense Assessments are levied per unit based on square footage and are due monthly. Special Assessments (for capital improvements or other lawful purposes) require approval of 67% of owners and Declarant during the Period of Declarant Control. Enforcement Assessments cover costs incurred from violations or collection. Utility Assessments may apply if the association is billed for separately metered utilities.
