What Scottsdale Northwest Airpark's governing documents say
This is the Declaration of Master Restrictions for the Scottsdale Northwest Airpark, a master-planned community in Scottsdale, AZ, designed to include private aircraft taxiways and hangar facilities. The document establishes baseline standards for all property within the airpark, including minimum lot sizes, architectural review, and shared maintenance of taxiways and common areas. These master restrictions run with the land and are binding on all owners; individual subdivisions may have stricter rules.
- Architectural review: All construction, including buildings, fences, landscaping, signs, and exterior changes, must be approved by a Design Review Committee (Architectural Committee) of the Property Owners Association. Plans must show plot, elevations, materials, and landscaping. Approval is deemed granted if the committee fails to respond within 30 days of a written request.
- Minimum lot size: No lot may be smaller than 20,000 square feet. Lots can be combined as long as the remainder meets the minimum size. Re-platting requires committee and city approval.
- Aircraft & taxiway access: The community includes a private taxiway system with reciprocal easements for aircraft ingress/egress among all property owners. The association maintains the taxiways and common master identification areas; costs are allocated proportionally based on net acreage. The association may regulate taxiway traffic and safety.
- Common area assessments & maintenance: The association is obligated to maintain common landscaped master identification areas and the taxiway system. It charges all property owners a quarterly fee (billed in advance) based on proportionate net acreage. Nonpayment becomes a lien on the property and may be foreclosed.
- Property maintenance & appearance: All buildings, improvements, and vacant land must be kept safe, clean, and in good repair. Vacant land must be treated or surfaced to be weed-free. Outside storage must be screened. Roof-mounted HVAC, floodlights, and exterior speakers are regulated to avoid disturbing neighbors. Painted surfaces must be maintained; unpainted metal hangars are allowed if neat.
- Parking & vehicles: Off-street parking areas must be provided per Scottsdale building codes, and the architectural committee can require more parking. Parking and taxiway areas (including driveways and aprons) must be paved with hard surface material.
- What this document doesn't cover: This is a master declaration; individual subdivisions within the airpark may establish their own CC&Rs that are more restrictive. This document does not address leasing, pets, or age restrictions. It does not contain specific rules for individual lots beyond minimum lot size and architectural review.
