Sundown Manor Unit Two is a single-family residential subdivision in Scottsdale, AZ, governed by a set of recorded restrictive covenants (not an HOA). These restrictions run with the land and apply to each lot. There is no homeowners association, common areas, or assessments; the rules are enforced through court action by lot owners.
- Use restrictions (residential only): All lots are for residential use only. No business, store, office, hospital, sanitarium, theater, saloon, or other commercial activity is allowed on or from any lot.
- Minimum house size & height: Each dwelling must have at least 2,200 square feet of ground floor area (excluding garage, porches, and patios) and cannot exceed one story in height.
- Setbacks & building lines: The nearest wall of a house or garage must be at least 40 feet from the front property line. Side and other restrictions must comply with Scottsdale's building code.
- Detached structures & fences: No detached buildings, trailers, or temporary structures are allowed, except a garage. Swimming pools and barbecue arrangements are permitted but must not inconvenience neighbors or cause unsightliness. No fence or wall (other than the house wall) may exceed 6 feet in height. No structure, hedge, or shrubbery (except grass) may be within 10 feet of the front street line, and no wall or fence within 40 feet of the front lot line.
- Clotheslines: Clotheslines shall not be placed nearer to the front property line than the rear line of the house, but may be in the side yard if fenced and screened from front view.
- Livestock & horses: No livestock or poultry may be kept on any lot, except that horses are allowed on Lots 5 through 8, provided they are quartered and stalled only on the rear one-third of the lot, not allowed to graze or be tied elsewhere, and stables and grounds must be kept clean and sanitary.
- Signs: Only one 'For Sale' or 'For Rent/Lease' sign, no larger than 18" x 24", is allowed on a lot. No other advertising signs, billboards, or unsightly objects are permitted.
- Duration & modification: These restrictions run with the land until April 15, 2003, and automatically extend for successive 10-year periods unless a majority of lot owners vote to change them.
